Accident ticket dismissed. Can other party still use police report against me in civil court?
Florida: I was in a sideswipe accident and was given the ticket. In my opinion, I was not at fault. My insurance company told me that the other party hired a lawyer and is filing suit against my policy. I volunteered to go to traffic court, and I went this week. The ticket was dismissed because the other car's occupants did not show up to testify as witnesses for the cop. I know that insurance companies and lawyers do their own investigations and that whether I paid the ticket (aka plead guilty) or not may not necessarily be allowed to be entered as evidence in civil court, but can the other party still use the police report as leverage against me? I mean, the citation listed on the report is no longer valid. Does that negate what the police determined to have happened in the accident?
